NRI PAN Update 2026 What Existing PAN Holders Must Do
An NRI PAN update does not normally require an existing holder to obtain a new PAN. Form 93 under the Income-tax Rules, 2026 is relevant to a fresh PAN application by an individual Indian citizen; it is not a compulsory annual filing for every non-resident Indian. PAN 2.0 is a technology-modernisation project, not a direction to replace every valid PAN card.
The Government’s PAN 2.0 clarification states that existing valid PAN holders need not apply for a new PAN merely because of the upgraded system.
Separate citizenship from tax residence
Citizenship answers who the person is under nationality law. Residential status under the Income-tax Act is determined mainly by physical presence and statutory conditions for the relevant tax year. An Indian citizen living abroad may be non-resident, resident but not ordinarily resident, or resident and ordinarily resident depending on facts.
The PAN database does not conclusively determine tax residence. Use passport travel, employment and Indian income facts. The NRI taxation and FEMA page and NRI tax consultant page cover the linked return, DTAA and remittance issues.
When Form 93 is relevant
Form 93 is for fresh PAN allotment to an individual who is an Indian citizen under the 2026 Rules. A person applying from outside India should review the prescribed identity, address and citizenship documents. A foreign citizen or OCI applicant may fall under the corresponding prescribed form rather than Form 93.
An existing PAN holder should not submit a fresh allotment application. Holding more than one PAN is prohibited and can create KYC, TDS and return mismatches.
What an existing NRI should update
e-Filing profile
Review contact details, address, bank accounts and profile information on the Income Tax e-Filing portal. Use an accessible email and mobile number so notices and verification messages are not missed.
PAN particulars
If the PAN database contains an outdated address, name or other prescribed particular, use the applicable correction process such as PAN CR-01 under the new framework. A correction does not generate a second PAN.
Bank accounts
Inform the bank when residential status changes. A resident savings account may need conversion to an NRO account; eligible foreign earnings can be managed through NRE or FCNR accounts subject to FEMA. The RBI NRI account FAQ is the official starting point.
Investment KYC
Update mutual fund, demat, broker, insurance and other financial KYC records. PAN correction does not automatically update every intermediary.
TDS status
Tell the payer and deductor about non-resident status where relevant. TDS on property, rent, interest or other income may differ. Review tax treaty documentation and lower-deduction options where available.
Income-tax return
Select the correct residential status and ITR form. Report Indian-source income and foreign assets or income only as the law requires for that status. ITR filing services can assist with AIS, TIS, Form 26AS and DTAA reconciliation.
PAN 2.0 does not invalidate the old card
PAN 2.0 is intended to consolidate services, improve validation and provide enhanced QR functionality. A PAN card without the latest QR feature does not become invalid merely for that reason. A reprint or update may be requested where needed, but the ten-character PAN continues.
Taxpayers seeking a fresh electronic PAN in eligible cases can review instant e-PAN and Aadhaar services. NRIs should not assume Aadhaar-based instant PAN is available or appropriate without checking eligibility.
NRI action checklist
- Calculate residential status for each tax year.
- Keep the existing PAN; do not apply for a duplicate.
- Correct PAN particulars only where inaccurate.
- Update the e-Filing profile and validated bank accounts.
- Convert resident bank accounts as FEMA requires.
- Update KYC with each investment intermediary.
- Inform payers so TDS is applied on the correct status.
- File the correct ITR and preserve DTAA documents.
- Review NRI repatriation support before moving Indian funds overseas.
Frequently asked questions
Must every NRI file Form 93 after 1 April 2026? No. It is a fresh PAN application form, not a recurring declaration by existing PAN holders.
Does the PAN number change after becoming non-resident? No. The existing PAN continues.
Does updating PAN convert a savings account to NRO? No. The bank-account conversion is a separate FEMA and banking process.
Does PAN status decide TDS? The payer must apply the tax law to actual residential status and payment facts; a database label is not conclusive.
Conclusion
The sensible NRI PAN strategy is continuity with accurate updates: retain the same PAN, correct particulars, update the e-Filing profile, regularise bank and investment KYC, and report residential status correctly in the ITR. Form 93 and PAN 2.0 should not be turned into a duplicate-PAN exercise.
