Crypto ITR Mismatch Reconcile VDA Transactions Before Notice
A crypto ITR mismatch usually begins with data that does not reconcile: one per cent TDS is visible but Schedule VDA is blank, exchange turnover exceeds the declared figures, or bank deposits cannot be linked to a transaction ledger. The solution is not to report only withdrawals. It is to reconstruct every taxable transfer.
Government data placed before Parliament records detection of ₹888.82 crore of undisclosed income relating to virtual digital asset transactions through search and survey actions. The same official response notes Section 194S non-compliance at certain exchanges. The Parliamentary answer is more reliable than viral notice-count headlines.
Understand the two core tax rules
Section 115BBH taxes income from transfer of a virtual digital asset at 30%, subject to the statutory restrictions. Apart from cost of acquisition, ordinary deductions are generally not permitted, and loss from one VDA cannot be set off against income from another or carried forward under this regime.
Section 194S requires one per cent TDS on consideration for transfer, subject to conditions and thresholds. TDS is a transaction trail and tax credit; it is not the final 30% tax. Review the official VDA TDS guidance.
Create a complete transaction ledger
Export trade history, deposits, withdrawals, fees and TDS data from every Indian and overseas exchange. Add self-custody wallet records and peer-to-peer transactions. For each disposal, record:
- Date and time
- Asset transferred
- Quantity
- INR value of consideration
- Cost of acquisition attributable to that asset
- Transaction fee and its treatment
- TDS deducted and deductor details
- Exchange or wallet reference
- Resulting income under the applicable rule
Preserve the original CSV files and a read-only copy. Screenshots are useful but should not replace machine-readable history.
Identify taxable transfers correctly
Sale for rupees is an obvious transfer. Crypto-to-crypto swaps, use of tokens to buy goods or services and certain peer-to-peer disposals can also be transfers even if money never reaches the bank. Moving the same asset between wallets owned by the taxpayer is ordinarily not a sale, but document wallet ownership and transaction hashes.
Do not calculate tax from the net cash withdrawn during the year. A taxpayer can withdraw less than invested and still have taxable gains on individual profitable transfers because loss set-off is restricted.
Reconcile four data sources
Exchange ledger
This establishes transactions and values but may use differing valuation conventions. Review missing-cost and duplicate-transfer flags.
Wallet and blockchain trail
Link exchange withdrawals to self-custody deposits so internal transfers are not mistaken for disposals.
Bank statement
Explain every fiat deposit and payment connected with exchanges, P2P buyers or sellers.
AIS Form 26AS and TDS certificates
Match Section 194S credit transaction by transaction. A TDS entry with no corresponding Schedule VDA disclosure is an obvious verification risk.
Taxpayers may use ITR filing and reconciliation services or Wealth4India ITR filing for a return-ready working.
What to do when income was omitted
First recompute the correct liability and identify the statutory correction route available for the assessment year. A revised return, ITR-U updated return, rectification or notice response serves a different purpose. ITR-U may involve additional tax and statutory restrictions; it should not be filed before confirming that the omission and computation are correct.
If a notice has arrived, verify it on the portal, preserve the deadline and answer the specific proceeding. Attach the transaction ledger, exchange reports, cost evidence, wallet map, bank reconciliation and tax computation. Faceless assessment representation or income-tax notice support may be appropriate for material disputes.
Common errors
- Reporting only gains converted to INR
- Setting off loss from one token against profit from another
- Treating one per cent TDS as final tax
- Omitting crypto-to-crypto swaps
- Using estimated cost without purchase records
- Counting self-wallet transfers as sales
- Ignoring foreign exchange accounts
- Reporting gross trading volume as income
- Failing to deduct TDS in a P2P transaction where the obligation applied
Frequently asked questions
Can VDA loss be adjusted against another VDA gain? The statutory regime restricts such set-off; compute each transfer accordingly.
Is transfer to my own wallet taxable? Mere movement between wallets owned by the same person is ordinarily not a sale, but maintain evidence of common ownership.
Can the Department see foreign exchange transactions? Offshore platforms serving Indian users can fall within reporting, TDS and AML frameworks; undisclosed activity should not be assumed invisible.
Does paying 30% make crypto legally regulated? Taxation does not by itself confer broader regulatory approval.
Conclusion
Crypto compliance is a data problem before it becomes a legal problem. A complete transaction ledger that ties exchanges, wallets, banks and TDS records to Schedule VDA is the strongest defence against a mismatch. Reconcile now, while the original data and access credentials are still available.
